These Terms of Service govern access to mondressya.shop and orders placed with the merchant operating under the Mondressya trade name. By using the site or submitting an order, the user agrees to these Terms, the Return and Refund Policy, Privacy Policy, Shipping Policy, Legal Notice, and product-specific terms disclosed before checkout. Mandatory consumer rights prevail over any inconsistent clause.
The storefront using mondressya.shop is operated by the merchant identified in the live site's legal and checkout disclosures. Before accepting orders, the merchant must insert its verified legal name, entity type, principal or mailing address, state of formation, registration details where required, customer-service contact, and any fictitious-name information. The domain and brand name alone do not identify a legal operator.
Questions may be sent to info@mondressya.shop. An order is the customer's offer to purchase. A contract is formed only when the merchant accepts the order through the method stated during checkout, subject to applicable law.
A person placing an order must be at least 18 years old or the age of majority in their jurisdiction, or must act with valid involvement and consent of a parent or legal guardian. Age-restricted goods are supplied only where the purchaser and recipient satisfy applicable age and verification rules.
A person ordering for a business confirms authority to bind it. We may request proportionate age, identity, authority, delivery, sanctions, export, or fraud-prevention checks before accepting or releasing an order.
We grant a limited, revocable, non-exclusive, non-transferable right to access the site for lawful personal or internal business shopping. The site, its content, and availability may change. We may suspend access for maintenance, security, abuse prevention, legal compliance, or operational reasons. We do not promise uninterrupted or error-free access.
Users are responsible for their internet connection, compatible device, browser settings, and reasonable security precautions. Automated access, scraping, indexing beyond ordinary search-engine functions, load testing, vulnerability probing, or circumvention of access controls is prohibited unless we give written authorization or applicable law expressly permits it.
If account registration is available, the user must provide accurate information, keep it current, protect credentials, and promptly report suspected unauthorized access. The user is responsible for activity reasonably attributable to their account until the store receives notice and has a reasonable opportunity to secure it, except to the extent applicable law provides otherwise.
We may require a password reset, additional verification, or account suspension where there is a security concern. We may close inactive, fraudulent, abusive, duplicative, or unlawfully used accounts. Closing an account does not erase transaction records that must be retained and does not cancel an accepted order or unresolved obligation.
The store offers dresses, apparel, fashion accessories, bags, footwear, and related lifestyle products accurately presented on the store. We aim to describe material features accurately using supplier, manufacturer, and internally prepared information. Images are illustrative and screen settings, lighting, production variation, packaging updates, or natural materials may cause reasonable differences. Measurements and specifications may use tolerances stated by the manufacturer or ordinary to the product.
Customers must read the full product page and confirm suitability for the intended purpose, location, user, size, model, voltage, fuel, connection, climate, code, installation, material sensitivity, or compatibility. A recommendation or search result is not a professional diagnosis or guarantee. Contact us before purchase if a missing fact is material to the decision.
Customers must review measurements, size charts, fabric content, opacity, stretch, care instructions, embellishment warnings, and intended use before wearing or cleaning an item. The customer is responsible for arranging any permit, site preparation, inspection, qualified trade, or professional advice needed for lawful and safe use. Product installation must comply with the manual, warranty conditions, building or electrical codes, and other applicable standards.
Do not use a product that appears damaged, recalled, incompatible, counterfeit, or unsafe. Disconnect it when safe, preserve evidence, and contact us. We may provide manufacturer or regulator information, but website content does not replace professional advice in electrical, gas, structural, medical, food-safety, child-safety, or other specialized matters.
Prices for the U.S. storefront are ordinarily displayed in U.S. dollars. Unless the store clearly states otherwise, product prices do not include sales, use, local, recycling, delivery, or similar taxes and fees that must be calculated from the actual transaction and destination. All mandatory charges controlled by the merchant are disclosed before the order is submitted.
A displayed price may change before acceptance. If a price, promotion, tax, availability statement, or product detail is clearly erroneous, the merchant may correct it and reject or cancel an unaccepted order. Any captured amount for an order that is not accepted will be returned through the original payment method.
A promotion is subject to its stated dates, eligible products, customer or geographic restrictions, minimum spend, quantity limits, and exclusions. Unless stated otherwise, discounts cannot be combined, transferred, redeemed for cash, or applied retroactively. A code may be disabled where it is expired, misused, published contrary to its conditions, or affected by an error.
If a return causes the retained order to fall below a promotion threshold, the refund may be recalculated to reflect the benefit actually retained, as explained in the Return and Refund Policy. We may limit quantities or cancel transactions that reasonably appear to exploit a promotion through automation, multiple accounts, resale, or other abuse.
The customer makes an offer to buy by completing checkout and submitting payment information. An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we send a shipment confirmation or another express acceptance notice, unless mandatory law determines an earlier time.
Before acceptance we may verify payment, inventory, address, product or delivery restrictions, fraud signals, quantity limits, and listing accuracy. We may reject or cancel an order for a legitimate reason, including stock unavailability, payment failure, suspected fraud, resale activity, legal restriction, safety issue, obvious error, or inability to deliver. Affected payment will be reversed or refunded.
By submitting payment, the customer authorizes the payment provider and merchant to charge the displayed order total and to process reversals, refunds, or adjustments permitted by these Terms. A temporary authorization hold is not necessarily a completed charge and may remain visible until the customer's financial institution releases it.
The customer must use a payment method they are authorized to use and provide accurate billing information. We may use address, device, transaction, and other risk information to prevent fraud. If payment is reversed, disputed, or fails after fulfilment, the customer remains responsible for the lawful amount unless the transaction is resolved in their favour.
Sales and use tax is collected where the merchant or platform is required to do so based on nexus, marketplace-facilitator rules, product taxability, exemptions, and destination. A customer claiming exemption must provide valid documentation. The merchant must not copy another business's tax registration or claim an exemption that has not been verified.
If goods cross a border, customs duty, import tax, brokerage, and other government charges may arise. Responsibility depends on the delivery terms and checkout disclosure. Accurate order and product information may be provided to carriers, brokers, payment providers, and authorities where reasonably necessary or legally required.
Shipping is governed by the Shipping Policy. Free standard shipping applies to all orders, and the standard estimated delivery time is 15-20 business days, subject to the qualifications in that policy. Estimates are not guaranteed dates. A separate written commitment or a mandatory legal delivery rule may create additional rights.
Delicate, embellished, or multi-piece garments may use protective packaging and separate fulfillment parcels. The customer must provide a complete deliverable address and monitor tracking. Carrier selection, route, scan cadence, and delivery method may vary. Ownership and risk are allocated under the Shipping Policy and mandatory law; a carrier scan does not conclusively resolve a properly supported non-receipt claim.
Title to goods passes when the purchase price is fully paid and the goods are delivered, unless the sale contract or mandatory law provides otherwise. Risk of accidental loss or damage transfers on delivery to the customer or a person authorized by the customer. If the customer independently appoints a carrier not offered by us, risk may transfer when goods are handed to that carrier where law permits.
A customer must take reasonable steps to protect a delivered parcel, including using secure delivery instructions and promptly collecting items left at a pickup point. We remain responsible for addressing confirmed fulfilment errors and for any carrier risk that the law or our shipping commitment places on us.
The Return and Refund Policy provides a 30-day request window for eligible returns and explains condition requirements, exclusions, return shipping, inspection, refund timing, defects, wrong items, exchanges, and cancellations. That policy forms part of these Terms. Product-specific return conditions disclosed before purchase also apply.
No return term limits a mandatory remedy for defective, unsafe, misdescribed, or unlawfully supplied goods. A refund to the original payment method may take additional time to appear after we submit it. A payment dispute should not be used to obtain duplicate recovery or to avoid returning an item when a lawful return is required.
A product may include a manufacturer's written warranty. Any such warranty is provided by the identified warrantor under its stated terms. The merchant will make warranty information available before sale where required and will not describe itself as an authorized dealer or warrantor unless that role is verified.
The Magnuson-Moss Warranty Act and FTC rules may apply to written consumer-product warranties. State law may provide express and implied warranties, and some states limit the ability to disclaim or restrict them. No disclaimer in these Terms applies where prohibited, and a written warranty or service contract may affect the lawful treatment of implied warranties.
The site design, original text, graphics, arrangement, software, databases, photographs owned by the merchant, and other merchant content are protected by copyright, trademark, and other laws. Third-party product names, images, marks, and materials remain the property of their respective owners and are used for identification, description, authorized resale, or another lawful purpose.
A user may view and print reasonable portions for personal shopping or record keeping. Without permission, a user may not reproduce, republish, sell, license, frame, mirror, scrape, create a competing catalogue from, remove rights notices from, or commercially exploit site content, except to the extent law expressly permits.
If the store accepts reviews, questions, photographs, or other content, the contributor confirms they have the right to submit it and that it is accurate, relevant, lawful, and does not violate privacy, confidentiality, intellectual property, or other rights. The contributor grants the merchant a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, moderate, and display the content for store and product purposes.
We may remove spam, threats, unlawful content, personal data, irrelevant material, undisclosed paid endorsements, manipulated reviews, or content that violates reasonable community rules. We do not promise to publish every submission. Honest negative feedback is not removed merely because it is negative.
Users must not break the law; infringe rights; submit false information; impersonate another person; distribute malware; interfere with security; probe vulnerabilities; harvest personal data; send spam; manipulate reviews; use bots to defeat limits; engage in payment fraud; resell in breach of a disclosed restriction; or use a product or the site to harm another person.
We may investigate suspected misconduct, preserve evidence, restrict transactions, suspend access, cancel unaccepted orders, and cooperate with providers or authorities where lawful. Enforcement will be proportionate and does not remove a genuine consumer claim unrelated to the misconduct.
The site may use or link to Shopify, payment providers, carriers, social platforms, review tools, financing providers, manufacturer sites, or other third parties. A third-party service is governed by its own terms and privacy notice. A link does not imply endorsement of every statement, product, or security practice on the destination site.
We are responsible for selecting and configuring providers to the extent required by law, but we do not control an independent third party's entire service. Problems directly involving an order should still be reported to us; we may coordinate with the provider instead of requiring the customer to resolve a merchant responsibility alone.
We aim to keep material information current but the site may contain typographical, technical, inventory, translation, supplier-feed, or display errors. Availability can change between viewing and checkout. Historical content is provided for reference and may not be current. We may correct or update information without notice, subject to accepted orders and mandatory disclosure rules.
Maintenance, internet failure, cyberattack, provider outage, or events outside reasonable control may interrupt access. We use reasonable continuity measures but do not guarantee that every feature will always be available. Customers should retain order confirmations and policy copies relevant to a transaction.
Except for express commitments and warranties or guarantees that cannot be excluded, the site is provided on an 'as available' basis. We do not warrant that site access will be uninterrupted, that every error will be corrected immediately, or that a product will suit an undisclosed purpose. Product-specific express warranties remain governed by their terms.
This disclaimer does not apply to a representation we made that induced a purchase, to fraudulent or negligent misrepresentation where liability cannot be excluded, or to mandatory consumer guarantees. Any permitted implied-warranty exclusion is limited to the fullest extent allowed in the customer's jurisdiction.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss that was not reasonably foreseeable when the contract was made. For a claim relating to a specific product or order, the merchant's aggregate contractual liability is limited to the amount paid for that product or order, except where a higher or different remedy is required by law.
No limitation applies to fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot be limited, breach of mandatory privacy or consumer rights, or another liability that law prohibits us from excluding. A customer must take reasonable steps to mitigate avoidable loss.
To the extent permitted by law, a user who uses the site unlawfully or materially breaches these Terms is responsible for direct loss, third-party claims, and reasonable costs caused by that conduct. This does not require a consumer to indemnify the merchant for the merchant's own negligence, legal breach, product defect, or another matter for which such an indemnity would be unfair or unlawful.
A party is not responsible for delay caused by an event beyond reasonable control, such as severe weather, wildfire, flood, epidemic, war, civil disturbance, labour disruption, border closure, carrier network failure, government action, cyber incident, infrastructure outage, or supplier interruption, provided the affected party takes reasonable steps to mitigate and resumes performance when practical.
Force majeure does not permit the merchant to keep payment indefinitely without supplying the order. If performance becomes impossible or is delayed beyond a period that gives the customer a cancellation right under the contract or law, we will offer the appropriate cancellation, refund, or alternative.
A user may stop using the site at any time. We may suspend or terminate access for security, unlawful conduct, abuse, non-payment, or material breach. Termination does not affect rights and obligations already accrued, an accepted order, a return in progress, or provisions that by their nature continue, including payment, intellectual property, privacy, dispute, and liability terms.
These Terms are governed by the laws of the U.S. state in which the contracting merchant is established, without regard to conflict-of-law rules, except that a consumer retains mandatory protections and forum rights that cannot lawfully be waived. The merchant must insert the correct state only after verifying its legal operator and should not select a state solely for convenience.
Before formal proceedings, the parties should attempt in good faith to resolve the issue through customer service and reasonable exchange of information. These Terms do not impose arbitration, a class-action waiver, or a particular court unless the merchant later adopts a separately reviewed and conspicuously accepted agreement. Nothing limits a non-waivable right to contact a regulator, state attorney general, payment provider, small-claims court, or other competent forum.
If a clause is invalid or unenforceable, it is adjusted or severed only to the extent necessary and the remaining clauses continue. Failure to enforce a clause once is not a waiver. The customer may not assign an order or claim to evade product or promotion restrictions, but this does not limit assignment rights that law protects. We may assign the business with appropriate notice and continuing obligations.
These Terms and the policies and disclosures incorporated into them form the agreement concerning site use and the order, together with any product-specific written commitment. Headings assist navigation but do not limit meaning. English singular includes plural where context requires. Electronic communications and records may satisfy writing requirements where law permits.
We may update these Terms prospectively for legal, operational, technology, or business reasons. The version in effect when an order was accepted ordinarily governs that order unless a change is required by law or accepted by the customer. Material changes affecting account use are communicated where required.
